1. Who we are

Nogal Beat USA is an online store operated by Reine Étoile Enterprise LLC, a limited liability company with its place of business at 1900 N Bayshore Dr, Ste 1A 136, Miami, Florida 33132, United States. Throughout these Terms, "we", "us" and "our" refer to Reine Étoile Enterprise LLC trading as Nogal Beat USA.

2. Scope of these Terms

These Terms and Conditions govern your use of nogalbeatusa.com and every purchase made through it. By placing an order you accept these Terms. If you do not agree with them, please do not use the site.

We sell and ship only to the 48 contiguous United States and the District of Columbia. We do not ship to Alaska, Hawaii, U.S. territories, military addresses, or outside the United States. Our Shipping Policy lists the delivery area in full.

3. Who can buy

You must be at least 18 years old and able to enter into a binding contract to place an order. You are responsible for the accuracy of the information you provide, including the shipping address. Once an order is placed, the delivery address cannot be changed through the site; contact us directly and we will tell you what options are available.

4. Products and descriptions

We are an independent retailer. We sell furniture and lighting manufactured by third parties, including ZUO and Humanscale. We are not the manufacturer of these products and we are not affiliated with, endorsed by, or acting as an authorized agent of those brands unless a page on this site states otherwise. All manufacturer names, model names, trademarks and product images belong to their respective owners and are used to identify the products we sell.

We describe each product as accurately as we can, using specifications supplied by the manufacturer. Colors may vary between screens and the physical product. Dimensions and materials are those reported by the manufacturer. If a product you receive differs materially from its description on this site, contact us and we will resolve it under our Refund Policy.

Listing a product does not guarantee availability. If an item becomes unavailable after you order it, we will contact you and issue a full refund for that item.

5. Prices and taxes

All prices are shown in U.S. dollars (USD) and are exclusive of sales tax. Any applicable state or local sales tax is calculated and displayed at checkout before you confirm payment, based on your delivery address.

The price that applies to your order is the price displayed at the moment you complete checkout. We may change prices at any time, but a change never affects an order that has already been confirmed.

We make every effort to keep prices accurate. If a product is listed at an obviously incorrect price because of a technical or human error, we will contact you before processing the order and you may confirm it at the correct price or cancel it for a full refund.

6. Orders and acceptance

Submitting an order is an offer to buy. Your order is accepted when we send you an order confirmation by email. Until we send that confirmation, no contract exists between us.

We may decline an order when a product is unavailable, when we cannot deliver to the address given, when payment is not authorized, or when we reasonably suspect fraud. If we decline an order, we will tell you and refund any amount charged.

7. Payment

We accept online card payments only. Accepted cards are listed on our Payment Methods page. Payments are processed by our payment provider over an encrypted connection; we do not store your full card details on our systems.

Your card is charged when the order is confirmed.

8. Shipping and delivery

Shipping is free on every order within our delivery area, with no minimum purchase. Delivery takes up to 5 business days to process plus up to 12 business days in transit. Full terms are in our Shipping Policy, which forms part of these Terms.

Risk of loss passes to you on delivery. Please inspect your shipment on arrival and tell us promptly about any damage in transit, as described in our Refund Policy.

9. Cancellations, returns and refunds

You may return a product within 30 days of delivery if it arrived damaged, is defective, or is not the item you ordered. Approved refunds are issued within 7 calendar days. Full terms, including what is not eligible, are in our Refund Policy, which forms part of these Terms. Nothing here limits any right you have under applicable consumer protection law.

10. Warranty

Products are covered by the manufacturer's warranty where one applies. Details are on our Warranty page. Except as stated there and as required by law, products are supplied "as is" without additional warranties from us.

11. Intellectual property

The Nogal Beat USA name, logo, site design, and the text and layout we author belong to Reine Étoile Enterprise LLC. You may not copy or reuse them without our written permission.

We make no ownership claim over third-party trademarks, manufacturer product photography, or manufacturer specifications shown on this site. Those remain the property of their respective owners.

12. Acceptable use

Do not use this site to break the law, to interfere with its operation or security, to scrape it by automated means without our permission, or to resell our content. We may suspend access for any of these reasons.

13. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of any order is limited to the amount you paid for the products concerned. We are not liable for indirect or consequential losses, including lost profits or loss of use.

Nothing in these Terms excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be excluded under applicable law.

14. Governing law

These Terms are governed by the laws of the State of Florida and the federal laws of the United States, without regard to conflict-of-law principles. Any dispute arising from them will be brought in the state or federal courts located in Miami-Dade County, Florida.

15. Changes to these Terms

We may update these Terms. The version in force for your order is the one published on this page when you placed it. The date at the top shows when this page was last revised.
